Charitable Giving
- Charitable giving is the gift of a thing or right for generally useful purposes.
Charitable giving may be made to citizens, medical institutions, character-training institutions, institutions of social protection, and other similar institutions, charitable, research, and educational institu-lions, foundations, museums, and other cultural institutions, social, and religious organizations, the state and other subjects of civil law specified in Article 124 of this Code.
- Acceptance of charitable giving does not require the permission or consent of any person.
- Charitable giving of property to a citizen shall and endowment of property to legal persons may be made conditional by the donor on the use of the property for a specific purpose. In the absence of such condition, the charitable giving of property to a citizen is considered as ordinary gift, and in other cases the charitably donated property shall be used by the donee in accordance with the designated purpose of the property.
The legal person that accepted a charitable gift for the use of which a specific purpose is stipulated, shall keep a separate account of all operations pertaining to the use of the charitably donated property.
- If as a result of a change in circumstances the use of the charitably donated property in accordance with the purposes specified by the donor becomes impossible, the property may be used for a different purpose only with the consent of the donor, and in the event of the death of the citizen - donor or of the liquidation of the legal person donor - by decision of a court.
- Use of charitably donated property for purposes inconsistent with those specified by the donor or a change of such purposes that is not consistent with paragraph 4 of this Article, shall entitle the donor his heirs, or any other legal successor to demand the rescission of the charitable giving.
- Articles 578 and 581 of this Code shall not be applicable to charitable giving.
